Advances in communications and technology have brought with it an off-shoot phenomenon that has greatly impacted the way individuals and businesses connect and deal with each other. File Sharing, which usually follows the Peer-to-Peer (P2P) model, has made it possible for people to connect in an instant. It involves an exchange of files between two users: an uploader providing the file and a downloader, who receives the file. The files are usually stored and served by the personal computers of the users.

There was a time when, if you sought to view a movie, the only place you could go was the cinema. Then came videotape, which meant that you could record your favorite movies from your television and watch them time and time again, until the tape wore out. Purchasing movie videos meant that you could watch many movies before they came on the television, typically only a short time after they were released in the cinemas. But over the last few years, technology has moved at a tremendous pace. We are no longer tied to viewing movies on our televisions, or at the cinema, and we now have much more diversity over what movies we watch, when we watch them, and even where we watch them.

During the last couple weeks there’s been much noise over the BBC Newsnight show on Friday 24 February in which BitTorrent was accused of being a harbour for terrorists and pedophiles. Debatable as it is, it caused a surge of anger on the part of p2p users that can be seen on the BitTorrent forum. Ultimately the BBC officials had to appologize. Certainly no technology can be judged upon only by behaviour of a small portion of users and one should be careful choosing words. Moreover if we continued the line we could end up banning the Inernet itself, so the outrage of BitTorrent users is quite reasoned. However what’s more important and what both sides seem to have forgotten is the so-called sensitive legal issues concerning peer-to-peer file sharing. On one hand the technology was created for sharing all kind of music video and text files by allowing other users to copy your files and thus participating in a file sharing community. This technology can not be called illegal as it is capable of substantial non-infringing use, i.e. it does not necessarily imply acquisition and distribution of copyrighted material. While on the other hand the BitTorrent file sharing protocol is a perfect tool for acquiring next to any music or video file without paying a cent which no doubt causes losses to copyright holders. According to the U.S. Justice Department the total loss caused by internet-piracy exceeds hundreds millions dollars. And if we consider reliable the data provided by BBC that Torrent traffic accounts for more than a third of the internet, it becomes evident that the losses are more than substantial enough to be talked about.

The legal use of P2P movie downloads is currently under scrutiny, as the movie companies bare their teeth and growl. However, they are a bit like toothless dogs, who can bark but whose bites are next to useless as a weapon. At the moment the illegal use of P2P file sharing software to download copyrighted movies outnumbers legal downloads by around 5 to 1. There is very little likelihood of an individual being prosecuted for doing so for personal use, although they are taking more of chance if they are downloading with the intention of selling the pirated movies.

I remember when I owned a Playstation 1 many moons ago and I was fortunate enough to have a 2mbit connection to the internet. What did I do? Look around for the possibilities of getting stuff for my Playstation.This was before Bittorrent and in the glory days of Napster. Of course Playstation 1 could do one thing and that was paying games. You couldn’t play MP3 or watch any movies or TV shows on it so Napster wasn’t the best choice.
